Terms & Conditions

These Terms & Conditions ("Terms") form a binding agreement between you and DateShot AI ("DateShot AI," "we," "us," or "our") governing the DateShot AI mobile application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter this agreement. You may use the Service only in compliance with applicable law. The Service is not intended for children or for use on behalf of a minor.

2. Accounts

Some features require an account created through an available sign-in provider. You are responsible for safeguarding access to your account, providing accurate information, and notifying us promptly of suspected unauthorized use. You may not sell, share, or transfer an account in a way that circumvents purchase, entitlement, safety, or usage controls. We may reject, suspend, or close accounts that violate these Terms.

3. The Service and AI results

DateShot AI provides tools that use automated systems to create dating-profile-style images from reference photos, profile inputs, and selected scenes. AI output is probabilistic. Results may be inaccurate, unrealistic, offensive, incomplete, or unlike you; may contain artifacts; and may resemble existing people, places, clothing, or creative material by chance. We do not guarantee any particular result, number of usable photos, dating outcome, approval by a dating platform, or uninterrupted availability.

You must review every generated image before using or publishing it and clearly disclose that it is AI-generated or AI-edited where law, platform rules, or context requires. Do not use results to mislead someone about your identity, appearance, location, lifestyle, possessions, affiliations, or experiences.

4. Your content and permissions

"User Content" means photos, profile inputs, custom style images, support material, and other content you submit. You retain any ownership rights you have in User Content. You grant us a worldwide, non-exclusive, limited license to host, copy, process, modify, transmit, display to you and authorized reviewers, and create derivative outputs from User Content solely to operate, secure, support, and improve the Service and fulfill your requests. This license ends when the content is deleted from active systems, except to the extent continued retention is permitted by our Privacy Policy or required by law.

You represent and warrant that:

• you own User Content or have all rights, permissions, and consents needed for us and our providers to process it;
• each identifiable person depicted is an adult and has consented to the upload and AI processing;
• User Content and your use of results do not violate privacy, publicity, intellectual-property, contractual, or other rights; and
• User Content does not violate the prohibited-use rules below.

5. Generated content

As between you and DateShot AI, and to the extent permitted by law, we do not claim ownership of the output generated specifically for you. Laws about AI-generated material vary, and output may not qualify for copyright or may not be exclusive. Other users may receive similar output. Your rights in output remain subject to third-party rights, applicable law, app-store rules, and the terms governing any underlying User Content or model-photo elements.

6. Prohibited uses

You must not use or attempt to use the Service to:

• upload or create sexual content, nudity, content involving minors, exploitation, non-consensual intimate imagery, or content promoting violence, self-harm, hate, harassment, or illegal activity;
• impersonate, deceive, defraud, catfish, stalk, intimidate, discriminate against, exploit, or violate the rights of another person;
• create or distribute identity documents, evidence, political deception, defamatory material, or misleading endorsements;
• upload another person's face or private material without authorization;
• bypass safety checks, authentication, payments, rate limits, preview limits, credits, moderation, or technical restrictions;
• scrape, probe, disrupt, overload, reverse engineer, extract models or prompts, introduce malware, or gain unauthorized access to the Service or another account;
• use automated access except through interfaces we expressly authorize, resell the Service, or use it to train or benchmark another model without written permission; or
• use the Service or output in any unlawful, harmful, or high-impact decision context.

We may automatically moderate uploads and may remove content, restrict generation, preserve evidence, or report conduct when we reasonably believe it is necessary for safety or legal compliance.

7. Subscriptions, credits, and purchases

Purchases made in the iOS app are billed by Apple and are also managed through RevenueCat. The checkout screen shows the current price, billing period, included credits, and any introductory, promotional, or win-back offer before you confirm. Prices and taxes may vary by region and may change for future purchases.

• Weekly plan: unless cancelled, an auto-renewing weekly subscription renews at the displayed weekly price. It provides the displayed weekly credit allowance during an active entitlement.
• Credit packs: non-renewing credit purchases add the displayed number of credits. Additional credits do not expire merely because a weekly subscription ends, unless the purchase screen expressly states otherwise.
• Credit use: one generation normally consumes one credit. Weekly credits are used before additional purchased credits. Failed jobs are handled according to the retry or credit-return options shown in the app.

Manage or cancel an Apple subscription in your Apple ID subscription settings. Cancellation takes effect at the end of the then-current paid period unless Apple states otherwise. Deleting the app or your DateShot AI account does not itself cancel an Apple subscription. Use Restore Purchases where available to restore an eligible entitlement. Refund requests are governed by Apple's policies and applicable law and generally must be submitted to Apple. Credits have no cash value, cannot be transferred, and are not a bank account or stored-value instrument.

8. Manual review and support

If available, you may request manual review of a generated photo. This authorizes trained personnel and relevant providers to inspect associated reference photos, generated images, profile inputs, and technical records and, when appropriate, create or upload a replacement. Stated response times are estimates, not guarantees. Manual review is not professional advice and does not guarantee that you will prefer the result.

9. Privacy

Our Privacy Policy explains how we process photos, face-related image features, profile inputs, purchases, notifications, diagnostics, and account data. By submitting User Content, you instruct us to process it as described there.

10. Our rights

The Service, software, interfaces, branding, model-photo library, templates, selection and arrangement, documentation, and other materials supplied by us are owned by or licensed to DateShot AI and are protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. Feedback you provide may be used without restriction or compensation, but we will not publicly identify you as its source without permission.

11. Third-party services

The Service depends on third parties, including app stores, sign-in providers, cloud infrastructure, AI processors, notification services, and payment-entitlement services. Their terms may apply to your use of their features. We are not responsible for third-party services, content, or outages, but these Terms do not limit any rights you have directly against those providers.

12. Changes, suspension, and termination

We may add, change, limit, suspend, or discontinue features and may suspend or terminate access when reasonably necessary for maintenance, security, legal compliance, nonpayment, abuse, or a violation of these Terms. You may stop using the Service at any time and delete your account in Settings. Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, and dispute terms—will survive.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT WILL NOT BE LOST. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATESHOT AI AND ITS AFFILIATES, PERSONNEL, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OPPORTUNITIES, OR RELATIONSHIPS, ARISING FROM THE SERVICE OR OUTPUT. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DATESHOT AI FOR THE SERVICE DURING THAT PERIOD OR US$100. These limits apply only to the extent permitted by law and do not limit liability that cannot lawfully be limited.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless DateShot AI and its affiliates and personnel from third-party claims, losses, and reasonable costs arising from your User Content, your unlawful or prohibited use of the Service or output, or your violation of another person's rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.

16. Consumer rights and disputes

Mandatory consumer-protection rights in your country or state continue to apply. Before filing a formal claim, please email info@dateshotai.com with a description of the issue so both sides can try in good faith to resolve it informally. These Terms do not require arbitration, waive class-action rights, or select a governing jurisdiction unless a later version clearly says so.

17. Apple-specific terms

If you downloaded the app from Apple, these Terms are between you and DateShot AI, not Apple. Apple has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for claims relating to the app or your use of it, including product-liability, regulatory, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this section against you. You represent that you are not in a country subject to a U.S. Government embargo or designated as supporting terrorism and are not on a U.S. Government prohibited or restricted-party list.

18. General

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will stay effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, or transfer of the Service. These Terms and the Privacy Policy are the entire agreement concerning the Service, subject to purchase terms displayed at checkout. We may update these Terms and will post the new effective date and provide additional notice where required. Continued use after the effective date means you accept the revised Terms.
